There seem to be quite a few of these around. I'm guessing they are governed and need pump mods? Is the sump able to be swapped conventional yanmar oil sump/pan?

The pan and pickup from the Yanmar can indeed be swapped to the ThermoKing. And while they are fixed at 2400 RPM for the reefer application, they can be modified to be variable. They are a sweet little engine. However, they developed a bad reputation for being a quite noisy engine for APU applications. But, you're going to have your ear plugs in when riding, not trying to sleep. So, no worries.
I'd still argue for the 2 cylinder Kubota - cheaper, more readily available, better parts support and are well established in diesel bike conversions. In the link below I posted that a local group had about a dozen of them they had pulled from APUs they were trying to sell for $200 a piece, your choice. They were also slated to pull another 10 or 12 late spring or early summer. They have a terminal just an hour and half from you in Charlotte if you're interested.

I'll look into those. They seem a little more bulky but I assume the same pump mods to make variable speed is still an option. That starter is huge and negates the filter relocation. But I'll search the build threads. https://www.ebay.com/i/222568925839?chn ... 6208128669

I'm thinking along the lines of a track configuration with a cvt in the north/south orientation with shaft drive. Granted the kubota cannot match the smart cdi rpm and power curve but we can dream right?

Agreed that the direct drive starter is heavy and bulky. Good reason to go with the much lighter gear reduction starter. Also, the Kubota comes in at 117 lbs while the Yanmar is closer to 130. They're quite close on dimensions. And variable speed control is a no-brainer on the Kubota.
As reflected in the links below, the Kubota offers the option of a gearcase cover with the filter mounting on either side simply by swapping the cover. Additionally, you can attach the right angle adapter that allows for positioning the filter any direction you want. But then, the Yanmar may offer those options as well. Admittedly, my bias is rather transparent.

Okay I'm converted. All bow to kubota. I've been reading build threads and tech articles by using keyword z482. I think I found one from you where you asked about internal crank balancing. It seems these are the perfect middle ground between the 10 yan or clone and the 3 banger kubota. Yes I know that makes sense given the number of cylinders. Looking at lombardini not all 2 bangers are equal.
